Published in the DOU this Wednesday, 17th, law 14.817/24 establishes general rules for the appreciation of basic education professionals in the public network. The matter provides career plans, continued training and better working conditions for teachers, principals, inspectors and school technicians.
 
The text was presented five years ago by the then deputy and current senator Professor Dorinha Seabra.
 
By law, public schools must offer a career plan that stimulates the performance and development of these professionals for the benefit of the quality of school education; continued training for the permanent updating of professionals; and working conditions that favor the success of the educational process.
 
The career plans provided for in the standard must ensure decent remuneration that enables integration between individual work and the school's pedagogical proposal. Furthermore, entry into the career must occur exclusively through competitive examinations and qualifications.
 
The text also defines the weekly working hours of up to 40 hours per week, and for teachers who teach, part of this day will be reserved for studies, planning and evaluation, in accordance with the school's pedagogical proposal. The minimum period of teaching experience for the professional to be able to perform other teaching roles will be two years.

LAW No. 14,817, OF JANUARY 16, 2024
 
Establishes guidelines for valuing professionals in public basic school education.
 
THE PRESIDENT OF THE REPUBLIC
 
I make it known that the National Congress decrees and I sanction the following Law:
 
Art. 1 The implementation of the principle of valuing school education professionals, inscribed in item V of art. 206 of the Federal Constitution, with regard to professionals in public basic education networks, will comply with the guidelines set out in this Law.
 
Art. 2 Public basic school education professionals are those who, having the training required by law, perform the teaching function or pedagogical support functions for teaching, that is, school management and administration, planning, inspection, supervision and educational guidance , or even technical and administrative support functions that require technical or higher education in a pedagogical or similar area.
 
Art. 3 The appreciation of professionals in public basic school education will include:
 
I - career plans that stimulate professional performance and development to benefit the quality of school education;
 
II - continued training that promotes the permanent updating of professionals;
 
III - working conditions that favor the success of the educational process, ensuring respect for the professional and personal dignity of educators.
 
Art. 4 The career plans of public basic school education professionals will include the following guidelines:
 
I - entry into the career exclusively through a competition of tests and titles, which will assess the preparation of candidates in relation to general pedagogical knowledge and knowledge of the specific area of professional activity, always considered to guarantee the quality of the educational action;
 
II - career organization that considers:
 
a) effective possibility of periodic functional progression throughout the professional’s active service time;
 
b) progression requirements that encourage ongoing professional development;
 
c) interstice, at each career level, sufficient to meet quality requirements for professional practice for progression;
 
III - inclusion, among the requirements for career progression, of:
 
a) title;
 
b) permanent updating in continuing education courses and activities;
 
c) assessment of professional performance;
 
d) professional experience;
 
e) attendance;
 
IV - incentives for exclusive dedication to the same education network, preferably the same school;
 
V - career salary floor defined and updated in accordance with the national professional salary floor established by federal law, under the terms of item VIII of art. 206 of the Federal Constitution;
 
VI - setting the minimum and maximum salary values in the career in order to ensure:
 
a) a minimum value that attracts good professionals to the career;
 
b) a stimulating progression, from a financial point of view, at each career level;
 
VII - composition of remuneration that ensures the proportional prevalence of monetary remuneration for the position or job in relation to the remuneration of benefits;
