Senate CCJ studies banning social media accounts for children under 12

 
 
PL 2,628/22, which creates rules to protect children and adolescents on social media, is ready to enter the Senate's CCJ voting agenda. Authored by Senator Alessandro Vieira and reported by Senator Jorge Kajuru, the proposal provides for rules such as the prohibition of accounts for children under 12 years of age and digital advertising aimed at children.
 
"Today, there are studies around the world that prove the damage that is caused to the development of these young people, especially when they are children, up to the age of 12. When you transfer this to real life, you will not leave your child alone in a square at night, talking to anyone, interacting with anyone in any environment about any topic. On social media, that's what happens," ponders Alessandro.

"So, what the project does, in alignment with what the world is showing, is to create a series of rules and obligations for companies that make money from this, whether in the sense of limiting access for those who are not of the age, whether in the sense of creating mechanisms so that parents can have minimal control, an awareness of what their children access or can access on social networks. Create rules so that you have clarity, guaranteed access, no one is prohibiting you from having access to the social network or access to the internet, that's not it! But there have to be rules and transparency. There are a whole range of companies that make money from advertising focused on children and teenagers. So, we create a series of obligations for them", explains the author of the proposal.

The  - National Civil Aviation Agency must maintain ordinance 13.065/23 that allows the air transport of passengers under 16 years of age, protecting their right to a seat adjacent (side by side) to that of their guardian/family member, without charge additional fee for assigning the minor's seat, when purchasing tickets or if changes are necessary.

The MPF filed a lawsuit alleging that airlines have been charging additional fees for booking seats in advance, inducing parents or guardians to pay these fees to avoid being separated from minors.
 
In its ruling, the lower court ruled that the charge was only applicable in the event of a change of class or for a seat with legroom, for which the payment of an additional fee is normally required.
 
Already on appeal, asked that the effects of the sentence be suspended until the judgment of the appeal, but the judge highlighted in her decision that, although the number of complaints of this nature are not significant, "a social public policy should not be based on statistics, as it is enough to violate the fundamental right of a single child or adolescent for the State to be obliged to intervene to guarantee the full exercise of a constitutional guarantee, and the inertia of the regulatory agency due to a merely mathematical justification is unacceptable".
